Terms & Conditions (AGB)

  1. Scope of Application

UPGEAR is a label by PERLE Kampagnen & Events GmbH (hereinafter referred to as “we”, “us”, or “UPGEAR”). These Terms and Conditions apply to all orders placed via our website www.upgear.ch, as well as purchases made directly with UPGEAR, and govern the relationship between UPGEARand the customer.

By placing an order, the customer accepts these Terms in full.

  1. Products and Services

UPGEAR offers:

  • Custom Teamwear & Uniforms for clubs.
  • Athletes wear and related sports gear.
  • Fan Merchandise and co.

All images and descriptions are for illustrative purposes. Slight variations in color or design may occur due to screen settings or production updates.

  1. Order Process & Contract Conclusion
  1. By submitting an order via the website or by email, the customer makes a binding offer.
  2. A contract is concluded once UPGEAR confirms the order by email or upon payment receipt.
  3. For custom orders, final approval of design proofs by the customer is required before production begins.
  1. Prices
  • All prices are in Swiss Francs (CHF) and include VAT.
  • Prices for custom orders are based on individual quotes, depending on volume, customization, and delivery terms.
  • Shipping fees can be found in the shipping terms
  1. Payment Terms
  • We accept: Stripe (incl. Twint), Credit Card, PayPal.
  • Payment for custom orders must be made in advance, upon confirmation.
  • The customer agrees to pay the full amount for the goods ordered.
  1. Delivery & Production Times
  • Custom Orders: Production time is approx. 6 weeks after design approval and payment.
  • Non-Custom Orders: Delivery within approx. 14 days.
  • Delivery times are estimates. Delays caused by third parties (e.g., suppliers) do not entitle the customer to compensation.
  1. Retention of Title

All goods remain the property of UPGEAR until full payment is received.

  1. Warranty & Liability
  • We replace products unfree from material and manufacturing defects for 360 days from delivery.
  • For defective or incorrect items, customers must notify us within 48 hours of receipt.
  • UPGEAR is not liable for:
    • Slight deviations in custom designs once approved.
    • Delays due to force majeure (e.g., natural disasters, strikes).
    • Consequential damages arising from improper use.
  1. Returns & Exchanges
  • Custom Products cannot be returned unless defective.
  • Non-Custom Products may be returned within 30 days, in unused condition.

  1. Intellectual Property

All content, logos, designs, and images on upgear.ch are the property of UPGEAR and may not be used without written permission.

  1. Data Protection

Customer data is processed according to our Data Protection Policy in compliance with Swiss DSG and GDPR.

  1. Applicable Law & Jurisdiction
  • These Terms are governed by Swiss law, excluding conflict of law rules.
  • Jurisdiction is at the registered office of UPGEAR, unless mandatory law dictates otherwise.
  1. Final Provisions
  • Should individual clauses be invalid, this does not affect the validity of the remaining terms.
  • UPGEAR reserves the right to modify these Terms at any time. Changes apply from publication on the website.
